This information notice is provided pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (“GDPR”) and applicable national legislation regarding the protection of personal data. It describes the management and processing methods of the personal data of users who consult the website https://www.fc-moda.it (hereinafter, the “Site” or “Website”).

2. Types of Personal Data Processed
Through the Site, FC Moda may collect and process various types of personal data:

Browsing Data: The computer systems and software procedures used to operate this Site acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols (e.g., IP addresses, domain names, URI/URL addresses, information about the device and browser used). While this data is not collected to be associated with identified data subjects, it could potentially allow for user identification through processing and association with data held by third parties.

3. Purposes and Legal Bases for Processing
FC Moda processes users’ personal data for the following purposes:

Legal basis: Execution of pre-contractual measures requested by the data subject (Art. 6, para. 1, letter b GDPR) and the legitimate interest of the Controller to follow up on user requests (Art. 6, para. 1, letter f GDPR).

Legal basis: Execution of a contract to which the data subject is party or pre-contractual measures (Art. 6, para. 1, letter b GDPR), as well as compliance with legal obligations (Art. 6, para. 1, letter c GDPR) for all necessary administrative and fiscal procedures.

Sending commercial and promotional communications (Direct Marketing)

Subject to the user’s explicit consent, FC Moda may use contact details (such as email addresses) to send newsletters and advertising material related to FC Moda products/services.

We use aggregated data (in a way that does not directly identify the user) to improve the browsing experience and the functionality of our Site.

4. Processing Methods and Data Retention
Personal data is processed primarily through IT and electronic tools, using methods strictly related to the purposes indicated. FC Moda adopts adequate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of personal data.
Retention Period: Data is processed for the time strictly necessary to achieve the purposes for which it was collected. Specifically:

Contact data for information requests: Kept for the time necessary to fulfill the request and for further connected purposes (maximum 24 months).

Billing and purchase data: Kept in accordance with accounting and tax regulations (at least 10 years).

Marketing data: Until the user withdraws consent and, in any case, within the limits provided by law.
5. Communication and Disclosure of Data
In carrying out the activities described, personal data may be shared with:

Persons authorized to process data within FC Moda (e.g., administrative, commercial, and IT staff), who are duly instructed and bound by confidentiality.

Third-party service providers used by FC Moda (e.g., IT services, consultants, hosting, technical service providers), acting as Data Processors appointed pursuant to Art. 28 GDPR.

Judicial or administrative authorities where required by law, regulation, or EU legislation, or to enforce or defend a right of the Controller in court. User data is not subject to indiscriminate disclosure.
6. Data Transfer Outside the European Union
Should some service providers (e.g., hosting platforms, cloud services, newsletter providers) be located in non-EU countries, FC Moda ensures the adoption of adequate safeguards pursuant to Art. 44 et seq. of the GDPR (e.g., Standard Contractual Clauses) to guarantee an adequate level of protection.
7. Rights of the Data Subject
In accordance with the GDPR, the user (as the data subject) has the right to:

Access (Art. 15 GDPR): Obtain confirmation as to whether or not personal data is being processed and receive a copy of such data.

Rectification (Art. 16 GDPR): Obtain the modification or update of inaccurate or incomplete personal data.

Erasure (“Right to be forgotten”) (Art. 17 GDPR): Obtain the deletion of personal data in certain cases (e.g., data no longer necessary, withdrawal of consent, etc.).

Restriction of processing (Art. 18 GDPR): Obtain the restriction of processing in specific circumstances.

Portability (Art. 20 GDPR): Receive personal data provided in a structured, commonly used format and request its transmission to another Controller if technically feasible.

Objection (Art. 21 GDPR): Object to processing based on the legitimate interest of the Controller, unless there are compelling legitimate grounds to continue the processing.

Withdrawal of consent (Art. 7, para. 3 GDPR): Withdraw previously given consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
To exercise these rights, the user may send a written request to the contacts indicated in Section 1. FC Moda undertakes to respond within the timeframe required by law.
8. Right to Lodge a Complaint
If the user believes that the processing of their personal data violates current legislation, they have the right to lodge a complaint with the Data Protection Authority (in Italy: www.garanteprivacy.it) or the supervisory authority of the EU country where they reside or work.
9. Links to Third-Party Sites
The Site may contain links to other third-party websites. FC Moda is not responsible for the personal data processing methods of such third-party sites. We encourage users, when leaving our Site, to read the privacy policies of every other site that collects personal information.
10. Use of the FC MODA app
The FC MODA app for iOS and Android is a container that displays the fc-moda.it website: there is no separate or additional processing of data beyond what is described in this policy. The data processed is the same as in the web reserved area (B2B account and order data) and the Data Controller is the one indicated in section 1.
Data collected from the device: none. The app does not access location, contacts, camera, microphone or device storage, does not send push notifications, and does not collect advertising identifiers (IDFA) or any other device identifiers.
No tracking. Inside the app, analytics are switched off and no statistics, advertising or attribution cookies are set: no tracking as defined by Apple's App Tracking Transparency takes place, and no data is shared with third parties for advertising purposes or with data brokers. Only the technical session cookies required to sign in and a technical cookie storing the language remain active. Full details in the Cookie Policy.
Account deletion. From «My account» → «Delete account» every registered user can request deletion on their own. Access is blocked immediately and permanent deletion takes place after 14 days; within that period the request can be cancelled through the link included in the confirmation email. After 14 days the account cannot be recovered. Orders already placed are retained in anonymised form, as the Data Controller is required to keep accounting and tax records for the periods set by law. The app is distributed through the App Store (Apple) and Google Play (Google). Apple and Google independently process data relating to downloads, purchases and updates under their own privacy policies, over which the Data Controller has no control.
11. Changes to this Privacy Policy
This Privacy Policy may undergo changes over time, including as a result of regulatory updates or updates to the Site. Users are therefore encouraged to consult it periodically. In the event of significant changes, adequate notice will be provided via the Site or other available contact channels.
